Citys' Anticipatory Injunction Ruling July 5

Today the attorney for the city of Nanaimo and the attorney representing Dave Cutts made their case before the Supreme Court Judge who heard both submissions.

I would never presume to anticipate how His Honour will rule in this precedent setting case, but his decision will be made Friday morning July 5 at 9:30 am if I heard correctly.

There of course were convincing arguments from both sides, but the hurdle the Citys' attorney has to get over is a very high one as it basically presumes people will not obey the law as it now stands and proposes to put the court in the position of being between the citizens and their government.

I presume there are likely very good reasons why a municipality has never been granted an anticipatory injunction, and does raise the question of how many of our tax dollars are being spent on a precedent setting case?
