How Can City Award Tender?

Objections Can Be Filed Until July 15,2013

The above legal notice appeared in the Nanaimo Daily News on June 15, 2013 and clearly says anyone objecting to the application to replace the dams has until July 15, 2013 to file their objection.

Presumably this process is not simply a public relations campaign but is a necessary step that must be satisfied with the Comptroller of Water Rights, and given that it would follow the city can not proceed with the replacement of these dams until this obligation has been discharged, why you might ask are they willing to award a tender for work they may not be allowed to do?

Application Is To Replace Not Simply Remove

One thing I would find troubling with this application if I were directly affected is the fact the application is to replace the two dams. The application is not to simply remove the dams, which at this point is all the city has demonstrated it will be doing. For example they have no design build approved to replace the dams, nor the required permits to build new dams. In fact, there is no guarantee the city will in fact be able to follow through with reconstruction at all.

If enough people were to file their objections, and those objections were to be given real consideration, it is not unreasonable to assume this agency could not render a reasoned decision until the end of July at the earliest.

I repeat, why is the city wanting to commit taxpayers to a multi million dollar contract they may not be allowed to undertake?

    How do I object - I mean what is the procedure?

  2. You can file to appear as a delegate at the Monday Council Meeting and address council for either 5 or 10 minutes depending on how many others may also have filed as a delegate. You can fill out the application online on the city website. You will find the application at this link http://www.nanaimo.ca/delegation/request_to_appear.aspx Remember to change the date in the drop down at the top of the page to match Mondays date. You can file up until 11:45AM on Monday I believe, but you don't have to wait, You can file now.
