City of Nanaimo Injunction Not Heard Today

City Injunction Application Put Over To July 2

Dave Cutts who was named in the action by the city of Nanaimo to prevent any possible action that might interfere with the removal of Colliery dams represented himself in Supreme Court today.

Mr. Cutts properly noted he had not been given adequate time to prepare from the time he was served before he had to appear in court. He was unable to fund and hire legal counsel to represent himself and on that basis was unprepared to have the case heard today.

The court agreed with Mr. Cutts and has set a date of July 2 for the case to be heard, by which time Mr. Cutts expects to be properly represented by legal counsel.

The application was heard before a packed court room, in fact even the gallery upstairs was filled to capacity with supporters wishing to keep the Colliery Dam Park lakes. It is rare the gallery upstairs is pressed into service.
