Colliery Dams - Auxiliary Spillway Decided


Unanimous decision by Council 
resolves Colliery Dams Debacle

At the July 20 city council meeting, Mayor McKay brought back the motion previously defeated to deal with the Colliery Dams. That motion was tabled and Councillor Yoachim brought a motion which required Council to recess for fifteen minutes to consider the motion.

Due to some questions this motion raised Councillor Yoachim and the city manager and the manager of Legislative Services and the city lawyer (I presume) spent the best part of two hours going over the motion and crossing T's and dotting I's to craft the final motion.

The highlights of the motion unanimously passed by council include:

  • Select the Auxiliary Spillway (Labyrinth/Box Culvert, Open Channel alternative) as the Lower Dam remediation option
  • notify the Comptroller of this selection and prepare a design report and construction plan to be provided to the Comptroller on or before July 24
  • prepare a conceptual plan for the Middle Colliery Dam
  • in collaboration with Council develop Terms of Reference for a tendering process for the Auxiliary Spillway construction to be awarded by Sept. 1/2015
  • Re-establish the Technical Committee as a Select Committee, including two serving Councillors, the select committee to be included in a consultative role throughout the installation of the Auxiliary Spillway
  • in collaboration with Council develop terms of reference for an independent investigation and report on the Colliery Dam process with a focus on problems, and issues that have arisen related to engineering, governance, communications, and engagement with the public and other governments
  • draft a letter to the Provincial government outlining our concerns with respect to the process and the handling of this matter from a government to government basis
  • abandon all legal proceedings before the EAB
